Contracts
In the various life situations of couples – whether married or engaged to be married, parents or other family constellations – legal regulations do not always correspond to the individuals’ needs.
We provide you with an expanse of legal advice as reflected in our custom-made contracts. Whether a pre-nuptial or post-nuptial agreement, a separation and divorce agreement or a contract for couples not intending to marry – we will work with you to find the right solution. This also includes contracts in the context of parenthood in patchwork and rainbow families.
Our individually tailored contracts clearly reflect the diversity of your personal and financial circumstances.
Separation & Divorce
Latest when a marriage is in a crisis – ideally even before an intended separation – conclusive legal advice on the consequences of separation and, if necessary, divorce is essential.
Our advice covers all financial aspects that need to be clarified, including maintenance/alimony obligations, distribution of assets, the use of properties, the division of pension entitlements and other compensation claims.
Our approach is always solution oriented. We strive to reach amicable agreements. If necessary, we will strongly enforce them in court with a confident assertiveness.
Children
Contact arrangements and questions of parental custody need to be regulated in the best interest of the child – regardless of whether the parents are married or have lived together as unmarried parents. In the event of a separation, it is necessary to find a structured contact arrangement. Questions of parental custody may also be relevant, even if the parents have never lived together.
Our primary goal is to find an amicable solution, especially when it comes to children. If this cannot be achieved, our compelling representation in court custody and contact proceedings will effectively uphold your interests throughout any litigations.
Other child-related issues concerning parenthood and parentage, including surrogacy and adoption, usually need to be resolved by a court ruling. Our preparatory legal advice will support you before such proceedings are initiated. You can rely on our expertise and dedication during the ensuing court proceedings.
International
In an increasingly globalised world, family matters frequently extend beyond national borders. This is the case, for example, when spouses have different nationalities, move abroad or when family members live in different countries. The recognition and possible enforcement of foreign court verdicts also play a role.
Due to our experience in international family law, we are able to guide you through the complex interaction of different jurisdictions and find individualised solutions that meet your needs. In doing so, we keep an eye on the effects of the respective jurisdiction of the countries involved and the applicable law, which can lead to very differing results.
In order to clarify your questions regarding relevant foreign laws in the best possible way, we have a worldwide network of proven family law experts in their respective legal systems. These experts are often also members of the renowned International Academy of Family Lawyers, with whom we work closely. Our services range from drafting international pre-nuptial agreements and agreements on the consequences of divorce to support in- court and out-of-court proceedings abroad, both in relation to finances and child custody matters, as well as child abduction proceedings under the Hague Convention on the Civil Aspects of International Child Abduction of 1980. This also includes international adoptions and questions of surrogacy, which regularly involve several countries or legal systems.
